The thesis

Why now
i.
Retaliation is the most common federal employment claim — and the hardest to prove. The EEOC closes most without a finding because the contemporaneous record never existed.
ii.
Performance scores, Slack sentiment, calendar metadata — the same tools that watch workers can be turned against the ones who speak up. The defense needs its own record, captured first.
iii.
Most workers reach an attorney eight weeks after the harm. By then the threads are gone, the witnesses have moved on, and the version of events that survives is HR's.
